NY Building Energy Code
AI summary · 7/12/2026

New York's building energy code (based on the 2024 IECC and ASHRAE 90.1-2022, effective December 31, 2025) sets minimum efficiency standards for new construction and building system replacements in residential properties, ensuring your home meets current energy performance requirements. If you're doing renovations that involve replacing building systems, your contractor must comply with these standards; historic buildings and those without electricity or fossil fuel systems are exempt.

New York's Energy Conservation Construction Code requires all commercial and residential building projects—including system replacements—to meet the 2024 IECC and ASHRAE 90.1-2022 standards effective December 31, 2025, with state-specific amendments. The State Fire Prevention and Building Code Council administers the code and provides technical support through interpretations and variances; enforcement occurs at the municipal level, so verify requirements with your local building authority.

New York adopted the 2024 IECC and ASHRAE 90.1-2022 on July 25, 2025, with an effective date of December 31, 2025, applying to government, commercial, and residential buildings plus system replacements (excluding historic buildings and those without conditioning systems). The Division of Building Standards and Codes (contact: Emma Gonzalez-Laders, 518-474-4073) administers the code, provides technical support, and handles variances; municipalities enforce compliance locally, and state staff can assist with COM/REScheck tools for compliance documentation.

Program summary

Much of the information presented in this summary is drawn from the U.S. Department of Energy’s (DOE) Building Energy Codes Program and the Building Codes Assistance Project (BCAP). For more detailed information about building energy codes, visit the DOE and BCAP web sites.

The Energy Conservation Construction Code of New York State (ECCCNYS) requires that all government, commercial and residential buildings, including renovations involving building system replacement, must follow the 2015 International Energy Conservation (IECC) code. Historic buildings and buildings that do not use either electricity or fossil fuel for comfort conditioning are exempt from these requirements.

The State Fire Prevention and Building Code Council has the responsibility make amendments and provide technical support on the form of interpretations and variances. The State Fire Prevention and Building Code Council voted on March 9, 2016 to update the ECCCNYS. This current code was based on the 2015 IECC and 2013 ASHRAE 90.1, along with several NYS specific enhancements (the previous ECCCNYS was based on the 2009 IECC supplement and ASHRAE 90.1-2010). The newly adopted building codes became effective starting October 3, 2016.

Enforcement of the requirements rests with the governmental entity administering and enforcing the provisions of the Building Construction Code or the Fire Prevention and Building Construction Code applicable within the municipality.
